3. Children's Privacy
Our professional services are provided to children only with appropriate parent/legal guardian involvement and consent when required.
Our website, scheduling system, and payment process are intended to be completed by parents, legal guardians, or other authorized adults, not independently by young children.
Parents and guardians should submit information concerning their minor children rather than directing their children to submit personal information independently through our website or scheduling system.
Federal COPPA requirements can apply to websites and online services directed to children under 13 that collect personal information, as well as general-audience services that have actual knowledge that they are collecting personal information online directly from a child under 13. (Federal Trade Commission)
4. Confidentiality of Professional Information
Information obtained in connection with professional psychological services will be treated as confidential in accordance with applicable laws and professional requirements.
Florida law provides confidentiality protections for communications between psychologists and their patients or clients, subject to specified exceptions. (Florida Senate)
Reasonable administrative, technical, and physical safeguards will be used to protect confidential information from unauthorized access, use, alteration, or disclosure.
5. Disclosure of Information
We do not ordinarily provide your child's screening results or confidential information to a school, teacher, physician, tutor, therapist, or other third party without appropriate authorization, except when disclosure is authorized or required by applicable law.
Information may be disclosed when reasonably necessary:
• With the parent/guardian's authorization;
• To service providers assisting us with authorized business or professional functions, subject to applicable privacy requirements;
• To comply with applicable law, legal process, licensing requirements, or professional obligations;
• When disclosure is otherwise legally required or permitted; or
• In other circumstances specifically authorized by the parent/guardian or applicable law.
6. Schools and Other Third Parties
Screening results are provided to the parent/guardian unless other arrangements have been appropriately authorized.
Parents may choose to share screening results or recommendations with their child's school, physician, tutor, therapist, or another professional.
If a parent requests that AAA Learning Experts communicate directly with a school or another third party, additional written authorization or a Release of Information may be required.
7. Electronic Communications
Parents may choose to communicate with us by email, telephone, text message, videoconferencing, scheduling platforms, or other electronic methods.
Although reasonable safeguards are used, no electronic communication or internet-based system can be guaranteed to be completely secure. Parents should use discretion when sending sensitive information electronically.
By voluntarily using an electronic communication method, parents acknowledge the privacy risks associated with that method.
8. Online Scheduling and Payments
We may use third-party providers to facilitate scheduling, electronic forms, videoconferencing, assessment administration, payment processing, or other business functions.
These providers may collect information necessary to provide their services and may maintain their own privacy policies and terms.
We do not intentionally collect or retain complete credit or debit card information when payments are processed directly by an independent payment processor.
9. Data Security
We take reasonable measures to safeguard personal and confidential information under our control.
Florida law also imposes requirements on covered commercial entities concerning the security of personal information and certain security breaches. (Florida Senate)
However, no electronic storage, internet transmission, email system, or other technology can be guaranteed to be completely secure.
10. Records and Retention
Professional and business records may be maintained for the period required or permitted by applicable laws, regulations, professional standards, contractual obligations, and legitimate business requirements.
Florida law specifically addresses records maintained by psychologists and school psychologists. (Florida Senate)
Records will be disposed of using reasonable measures intended to protect confidential information when they are no longer required to be retained.
11. Parent/Guardian Rights
Subject to applicable laws and professional record requirements, a parent or legal guardian may contact us regarding:
• Questions about information maintained about the parent or child;
• Correction of inaccurate contact or demographic information;
• Requests concerning records;
• Authorization or withdrawal of authorization for certain disclosures; or
• Questions about our privacy practices.
Withdrawal of an authorization does not necessarily affect disclosures already made in reliance upon a valid authorization or information that must continue to be maintained under applicable law.
12. Website Information
Our website may automatically collect limited technical information, such as browser type, device information, IP address, pages visited, cookies, or similar information, depending upon the technology and third-party services used to operate the website.
Such information may be used for website functionality, security, analytics, and improving our services.
Third-party websites or services linked from our website are governed by their own privacy policies. We are not responsible for the privacy practices of independently operated third-party websites.
13. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes in our services, business practices, technology, or applicable requirements.
