Austin Ashby & Associates Psychoeducational Services

Also Known as AAA Learning Experts

These Terms of Service (“Terms”) govern the purchase and use of services provided by Austin Ashby & Associates Psychoeducational Services, also known as AAA Learning Experts (“AAA Learning Experts,” “we,” “us,” or “our”).

By scheduling, purchasing, or participating in our services, you acknowledge that you have reviewed and agree to these Terms and any applicable informed consent, privacy, payment, cancellation, and service-specific agreements presented to you.

1. Services

AAA Learning Experts provides psychoeducational services that may include Dyslexia Screening Assessments, parent consultations, educational consultation, screening and assessment services, interpretation of educational information, recommendations, and parent support.

The specific services provided will depend upon the service purchased and the individual circumstances of the student.

Professional assessment and consultation services are provided by appropriately qualified professionals, including Licensed School Psychologists, as applicable.

2. Screening Services

A Dyslexia Screening Assessment is a screening service and is not a comprehensive psychoeducational evaluation.

Screening services are intended to provide information regarding a child's skills, areas of concern, and whether identified difficulties may be associated with dyslexia or other learning concerns.

A screening does not guarantee or independently establish:

• A diagnosis;

• Eligibility for special education or Exceptional Student Education (ESE);

• An Individualized Education Program (IEP);

• A Section 504 Plan;

• School accommodations or modifications;

• Specific interventions or services; or

• Any particular academic, educational, behavioral, or other outcome.

Additional assessment or consultation with other professionals may be recommended.

3. Parent/Guardian Responsibility and Authority

When purchasing services for a minor, you represent that you are the child's parent, legal guardian, or another individual legally authorized to consent to the requested services.

You agree to notify us before services begin if custody orders, guardianship arrangements, parental rights, or other legal restrictions may affect your authority to consent to services for the child.

4. Information Provided by Parents/Guardians

You may choose to provide the Licensed School Psychologist with academic or medical records, previous evaluation results, teacher input, questionnaires or rating scales, intervention information, and other information relevant to your child.

Providing supplemental information is voluntary unless particular information is necessary to provide the requested service.

You agree that information you choose to provide will be accurate and complete to the best of your knowledge.

Screening results and recommendations may be affected when relevant information is unavailable, incomplete, inaccurate, or withheld.

5. Virtual Services

Some services may be provided virtually.

For virtual assessment services, the parent/guardian is responsible for providing an appropriate testing environment and required technology, including a compatible computer or device, reliable internet connection, camera, microphone, and other equipment identified before testing.

Technical problems, interruptions, environmental distractions, student behavior, or other circumstances may require testing to be paused, modified, continued at another time, or rescheduled.

6. Results and Recommendations

Screening and assessment results are based upon the information available at the time services are provided, standardized assessment procedures when applicable, behavioral observations, professional judgment, and other relevant information.

Recommendations provided by a Licensed School Psychologist are professional recommendations and do not guarantee a particular result or outcome.

You retain responsibility for deciding whether to follow recommendations and whether to provide screening results to your child's school, physician, tutor, therapist, or another individual or organization.

7. Schools and Third-Party Decisions

AAA Learning Experts does not control the decisions of schools, school districts, physicians, healthcare providers, tutors, therapists, intervention providers, government agencies, or other third parties.

We therefore cannot guarantee that a recommendation or screening result will result in an evaluation, diagnosis, intervention, accommodation, IEP, Section 504 Plan, eligibility determination, placement, service, or other requested outcome.

8. Free Parent Support

When included with a purchased Screening Assessment, free parent support may be available for up to two (2) months following the Screening Assessment.

Support may address screening results, recommendations, school concerns, educational interventions, communication with school personnel, and possible next steps.

Support may be provided by email, telephone, or text, depending upon professional availability and the nature of the question.

Complimentary parent support is not unlimited, immediate, emergency, crisis, or on-call service. Response times and communication methods may vary based upon the Licensed School Psychologist's professional schedule and obligations.

Free support may be modified, limited, or discontinued when reasonably necessary because of professional availability, misuse of the service, inappropriate communications, circumstances outside our control, or other legitimate professional considerations.

9. Payment

Payment is required according to the terms displayed when the service is scheduled or purchased.

Prices may vary by service and may change from time to time. The applicable price is generally the price presented when the service is purchased, unless an error or other circumstance requiring correction is identified.

Payment does not guarantee a particular screening result, recommendation, diagnosis, school decision, service, or educational outcome.

10. No Refunds, Cancellations, and Rescheduling

All payments are final and non-refundable, except when otherwise required by applicable law or expressly authorized by AAA Learning Experts.

If you cancel an appointment, your payment may be applied toward a rescheduled appointment rather than refunded.

If your child misses a scheduled appointment, the appointment may be rescheduled rather than refunded.

If AAA Learning Experts or the Licensed School Psychologist must cancel or reschedule an appointment, reasonable efforts will be made to provide another appointment at no additional charge.

Repeated cancellations, missed appointments, significant delays, or failure to complete required portions of the service within a reasonable period may affect our ability to complete the service.

11. Confidentiality and Privacy

Personal, educational, assessment, and other confidential information will be handled in accordance with our Privacy Policy, applicable professional requirements, and applicable law.

Information will not ordinarily be disclosed to your child's school or another third party without appropriate authorization, except when disclosure is required or otherwise permitted by applicable law.

Use of our services is also subject to the Privacy Policy and any applicable informed consent or authorization forms.

12. Electronic Communications

You may communicate with AAA Learning Experts through email, telephone, text messaging, videoconferencing, scheduling platforms, or other approved electronic methods.

Although reasonable safeguards may be used, electronic communications and internet-based services carry inherent privacy and security risks.

By voluntarily choosing an electronic communication method, you acknowledge those risks and authorize reasonable communications through that method regarding your requested services.

13. Professional Recommendations and Assumption of Decision-Making Responsibility

Recommendations and guidance provided by a Licensed School Psychologist are based upon professional judgment and information available at the time.

You may choose whether to follow any recommendation.

Because individual circumstances and third-party decisions vary, AAA Learning Experts and the Licensed School Psychologist cannot guarantee that following a recommendation will produce the intended or desired outcome.

You remain responsible for decisions you make regarding your child's education, healthcare, interventions, services, and other matters after considering the information and recommendations provided.

14. Limitation of Liability

To the extent permitted by applicable law, Austin Ashby & Associates Psychoeducational Services, also known as AAA Learning Experts; and their employees, contractors, representatives, and agents will not be responsible for decisions, actions, services, or outcomes resulting from actions taken by a parent/guardian, school, school district, healthcare provider, tutor, intervention provider, or other third party based upon screening results or recommendations.

Nothing in these Terms is intended to exclude, limit, waive, or release liability that cannot legally be excluded, limited, waived, or released under applicable law, including liability for conduct for which such limitation or waiver is prohibited.

15. No Emergency or Crisis Services

AAA Learning Experts does not provide emergency, crisis, or 24-hour services through its website, email, text messaging, scheduling system, parent-support service, or Dyslexia Screening Assessment program.

Electronic communications should not be used for emergencies.

16. Intellectual Property

Unless otherwise stated, original website content, educational materials, forms, graphics, written resources, and other proprietary materials created by AAA Learning Experts remain the property of Austin Ashby & Associates Psychoeducational Services.

Materials provided to families are for their personal and educational use and may not be reproduced, sold, published, or commercially distributed without authorization, except as otherwise permitted by law.

This provision does not claim ownership of standardized assessment materials, third-party materials, school records, or other content owned by another party.

17. Third-Party Services

We may use third-party platforms for scheduling, payment processing, videoconferencing, assessment administration, electronic forms, communications, or other functions.

Use of those platforms may also be subject to the third party's own terms and privacy policies.

AAA Learning Experts does not control independently operated third-party services.

18. Changes to Services or Terms

We may modify these Terms, policies, procedures, prices, or service offerings when reasonably necessary.

Changes will not retroactively eliminate contractual rights that cannot legally be modified without consent.

The version of the Terms applicable to a particular transaction will generally be the version presented or in effect when the service is purchased, subject to applicable law.

19. Governing Law

These Terms are governed by applicable federal law and the laws of the State of Florida, without regard to conflict-of-law principles, except where another jurisdiction's law is required to apply.

Nothing in these Terms is intended to limit rights or protections that cannot lawfully be waived.

20. Entire Agreement

These Terms, together with the applicable Parent/Guardian Informed Consent, Service & Privacy Agreement, Privacy Policy, payment and scheduling policies, and any other service-specific agreement expressly incorporated into the transaction, constitute the terms governing the applicable service.

If a service-specific consent form contains provisions that differ from these general Terms, the service-specific provisions should govern the applicable professional service to the extent permitted by law.

21. Electronic Acceptance

By typing your name, checking “I Agree,” scheduling and purchasing a service, or otherwise electronically accepting these Terms when presented with an opportunity to review them, you indicate your intent to enter into an electronic agreement.

Your electronic signature or acknowledgment is intended to have the same force and effect as a handwritten signature to the extent permitted by applicable law.
